1. Acceptance of Terms

2. Description of Services

Keystone Escondido Asphalt Paving provides residential and commercial asphalt paving and related services in Escondido, CA and surrounding communities. Services may include, but are not limited to, asphalt paving, sealcoating, crack sealing, pothole repair, parking lot striping, driveway paving, grading, drainage work, and related trade services.

The Site is provided for informational purposes and to allow customers to request estimates or contact us. Nothing on the Site constitutes a guarantee of service availability, scheduling, or specific pricing for any particular project.

3. Estimates and Pricing

Any estimate, quote, or price range referenced on the Site is for general informational purposes only and does not constitute an offer or binding contract. Final pricing is determined after an on-site assessment and is communicated to you in a written estimate.

Written estimates are valid for the period stated on the estimate document. If no period is stated, the estimate is valid for 30 days from the date of issue. Material cost changes, changes to project scope, or unforeseen site conditions discovered during the work may affect the final price. We will notify you of any material change before proceeding.

An estimate is not a guarantee of final cost. Actual costs may vary based on field conditions, changes requested by the customer, or circumstances outside our control.

4. Scheduling and Cancellation

Scheduling is subject to availability. We will work with you to find a mutually agreeable date and will confirm your appointment in advance. We reserve the right to reschedule work due to weather conditions, equipment issues, or other circumstances beyond our control. We will communicate any changes promptly.

If you need to cancel or reschedule a confirmed appointment, please contact us as soon as possible. Cancellations made less than 24 hours before the scheduled start time may result in a cancellation or mobilization fee, which will be stated in your written agreement if applicable.

We reserve the right to cancel or decline any project at our discretion, including situations where site access is unsafe, site conditions are unsuitable, or the scope differs materially from what was described during the estimate process.

5. Payment Terms

Payment terms will be set out in your written estimate or contract. Unless otherwise agreed in writing, the following general terms apply:

• A deposit may be required before work begins. The deposit amount will be stated in the written estimate.
• Final payment is due upon completion of work unless alternate terms have been agreed in writing.
• Accepted payment methods will be communicated to you before the project begins.
• Invoices not paid within 30 days of the due date may be subject to a late fee or referred to a collections process.

If you dispute any charge, please contact us in writing within 10 days of receiving the invoice. We will review the dispute and respond within a reasonable time.

6. Customer Responsibilities

You are responsible for ensuring clear, safe, and unobstructed access to the work area before the scheduled start time. This includes removing vehicles, equipment, furniture, and any other items from the paving area. You are also responsible for notifying us of any underground utilities, sprinkler systems, drainage features, or other subsurface elements in the work area before work begins. We are not liable for damage to undisclosed subsurface elements.

If your property is governed by a homeowners association or requires permits for the planned work, obtaining any required approvals is your responsibility unless we have explicitly agreed in writing to handle that on your behalf.

7. Warranty Disclaimers

Any workmanship warranty provided by Keystone Escondido Asphalt Paving will be stated in your written contract or estimate. Where a workmanship warranty is provided, it covers defects in our work under normal use and conditions. It does not cover damage caused by:

• Ground movement, soil settlement, or subsurface conditions not disclosed before work
• Flooding, standing water, or drainage issues outside the scope of our work
• Tree root intrusion
• Heavy vehicle loads beyond the design capacity of the pavement
• Customer alterations or work performed by others after project completion
• Normal wear from use, weather, or UV exposure over time

The Site and any general information it contains are provided "as is" without warranty of any kind. We do not warrant that the Site will be error-free or uninterrupted.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Keystone Escondido Asphalt Paving is not liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or our services, including loss of profits, loss of use, or damage to property, even if we have been advised of the possibility of such damages.

Our total liability for any claim related to a specific project will not exceed the amount paid by you to us for that project. This limitation applies regardless of the basis of the claim, whether in contract, tort, or otherwise.

9. Dispute Resolution

If you have a dispute with us related to our services, please contact us first at the information below. We will make a good-faith effort to resolve the issue directly within 30 days of written notice.

If the dispute cannot be resolved informally, both parties agree to attempt non-binding mediation before pursuing litigation. If mediation does not resolve the matter, any legal action must be brought in a court of competent jurisdiction in CA.

10. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising under these terms shall be subject to the exclusive jurisdiction of the courts located in California.

11. Intellectual Property

All content on the Site - including text, images, logos, and layout - is the property of Keystone Escondido Asphalt Paving or its content suppliers and is protected by applicable intellectual property laws. You may not reproduce, distribute, or use Site content for any commercial purpose without our prior written permission.

12. Modifications to Terms
